You know from a Republican to a Democrat. So we're covering that live for -- and we'll have some of that coming up in just a moment. And -- -- -- what leg and a -- and not becoming a BO which it by federal law. I don't think they have any leg at the answer and it's been talked about here in south Carolina's notification. And we talked about it again yesterday bill Chamblee Lester got a -- South Carolina House of Representatives. We talked to on this program yesterday with senator Tom Davis who came appear last night at a hearing on this whole thing because it's gonna be right they're near the top. The priority list windy South Carolina senate. A reconvenes coming up in January. Now is nullification to be all and end all probably not because the federal government their position. Is going to be we can pick and choose what number we want to do. And and somebody should take that all the way to the Supreme Court -- right. There's already nullification South Carolina did years ago was something called. The real ID act and large it's all about Sovereign States and we are Sovereign States standing up and saying we have no obligation. To Obey any law. That we deem unconstitutional. Now you have to read about in the founding fathers documents but. It's obvious you brought up the examples I brought up -- Look at all the Sanctuary Cities that is the nullification of federal law yesterday. You know are a lot but I think that time is come when we as Americans. That actually our country. Changing and triggering a wave that's something that's completely unrecognizable. -- so I think it's the time is now for -- to stand up why I drew one little. Not comply. What -- obamacare law to whatever degree I have to go. I I'm not alone obviously at a number of callers just recently support that back there. A lot you know we get it would get on the radio we could talk about it weakened. Complain how would go only -- complain how our state legislature may or may not be handling things horse from this state. I think it's time for the people just stand up and say no no I ought not comply. You know -- -- boys there's not been occurred obviously. If you look at the polls if you believe. The polls anyway I mean and and I don't know how are you can't but well if -- -- percent of Americans say now. I think our voices have been heard and think they're being ignored because. What do what Obama and the people who really support him what they are really counting on is. How I'd put this Chris they're counting on people being afraid. A free and their government. And -- and it's one thing not to trust them in I don't know why anybody would trust them. One thing to be angry at them but you have to get to the point where you're not afraid. Of them. Well I think wrecked the point where we need to make that stand we need this surcharge shall decide who and what we all in this country that will. And make that decision but we need to make it now I'm a number of -- just recently I'd like all the and I share what you know I've been feeling this way paper. Which is -- today madam secretary I repeat my request for you to resign thank you mr. chairman. I think Saturn. Mr. Menendez. Thank you chairman -- and secretary thank you for joining us this morning. You know while the problems we're facing what the marketplace web -- are substantial unacceptable yourself described that way. And need to be fixed immediately that I -- that take a second and put things and historical perspective. Social securities acts old age insurance plan facing hurdles. Problems beset Social Security. Social Security setup insane. Medicare facing trouble crisis for Medicare. New problems in Medicare drug benefit. The Medicare drug mess. Those -- headlines of the thirties sixties. And early. Of this decade. About major. Programs. That have become beloved. In terms of the social safety net in this country and health care security. So while this is on excusable by the same token if it is a challenge that has been based time and time. When any major program has been. Unveil and now. I find it amazing that those who seek to us that the ascribe blame on the same folks who have spent every. Waking hour of the last four years. Working to dismantle. Destroy. Obstruct. And impede the success of the affordable care. They're concerned not about its failure. They're concerned about its success. And so I hope that what will focus on is how do we succeed now. -- I wanna get a sense when those of us on the committee -- worked to put this bill together do I guess we were on the faulty assumption. Is that states controlled. By a Republican legislatures and governors. Would put higher premium on their love of state rights and the opportunity for their citizens. Is then their dislike of the president or some ideological political. Opposition. Which is why we're seeing far better success than in. Those states that have establish their own marketplace what is the consequence. Having so many of the states not pursue their own marketplace in delegating it to the federal government. I don't did you envision having that many states -- not open up their own marketplace and what's been the -- -- -- of the burden of well senator I would say we we really didn't know we knew that. 27 states had sued M -- around the constitutionality. Of the bill. There was a uncertainty what would happen if the court when the court declared constitutional. How those states would then. I react summit have chosen a sort of partnership where we still rom com. The bulk of the exchange others have refused to participate at all and I would say that uncertainty. -- certainly added to that uncertainty. How large the operation would be having said that we. Did have deadlines. In January of thirteen forced states to officially declare whether they would run there. Own marketplace or not and by the middle of February. A partnership plan but we we have 36 states who are using the federal -- at this point and that's I think significantly higher than. People might have predicted initially. At the at the -- other plan we have robust. Product offerings in those marketplaces. Very competitive about a fourth of the insurers are brand new. Which is a very good news to a lot of the people who have been in a monopoly market for a very long time they have choices they have competition and that was. I gotta tell you folks. Why would anybody believe that. -- the government doesn't control the health care system the thousands of doctors and nurses controlled health care system. What are the liberals going to do. If the doctors and hospitals don't go along with obamacare is already out there -- a lot of doctors even some hospitals you leave hospitals. Are saying we're not. But I I think you're wrong can Obama -- the government does control healthcare. Through the through all the regulations they're trying to control. The the health insurance industry. You know who are day to say that some policies are sub standard. -- by listening to Sebelius tried to talk technical. Should the same thing applied to Obama lying about obamacare. -- your current topic is why I have such disdain. For all the educated idiots in this country. This is just another Obama we -- and we -- the ropes. He won't let us see the right hand and smacked us with a left literally. All the while grinning and smiling at how easy it was to dupe the American people. It has happened time and time again we keep allowing him to do it and even though we now know. All of this is happening the Republican. -- shed is on the fix in on the deception. There's some of the text messages coming and so far this morning a couple of other things. All the excuses being offered. All the revelations. About obamacare. There may be a simple solution. Representative Fred Upton is a Republican from Michigan. He has introduced a bill in the House of Representatives that would actually allow individuals to keep their current insurance policies. Senator Mary -- She's a Democrat from the -- Deanna. Has introduced a village called keeping the Affordable Care Act promises act. These are laws forcing to -- blow up Obama to keep his promise. Who could be oppose what Harry Reid is and some Democrats senators -- Force Obama's hand. Bring these things up put into the test. Is Obama. And the Democrats I I guess they'd still Perry reborn. Also talking about web sites. The independent women's voice. Has set up a web site and it does work. It's called mind cancellation dot com. They are collecting some of you may want to log on to this because you're -- me text messages that you've been informed that your policies being canceled. My cancellation dot com. -- shallow. Washington examiner knows all the cancellation letters begin. With pretty much the same thing. Here's one. Due to changes handed down by the federal government and the patient protection and Affordable Care Act. Some -- our plans do not meet the minimum requirements. Outlined by Health Care Reform if you got a letter that says that. But Thomas Wilson writes in a historical moment where the president has lost touch with reality. The collection of actual people facing actual consequences. Is invaluable. And he says the independent women's voice. It is a sister organization to the independent women's or -- both groups deserve credit here. Mine cancellation. Dot com. Obama canceled your health insurance now they say send us your letter. The letter you're getting it in the back at my cancellation dot com and one more thing which is very telling I didn't know that there's still this morning. Here's a guy named Robert Payer. The rights with the New York Times. And he is revealed something amazing. That the Obama administration is claiming. That obamacare doesn't have to meet get this folks the same. Anti corruption standards applied to whether -- here's what he writes. The Affordable Care Act is the biggest new health care program and decades. But the Obama administration has ruled. That neither the federal insurance exchange. Nor the federal subsidies paid to insurance companies on behalf of low income people. Our quote quote federal health care programs. So what Obama cares not a federal health care program. He -- the surprise decision disclosed last week. Exams. Subsidized health insurance from a law. That -- rebates kickbacks bribes. And certain other financial arrangements in federal health programs. Which what does that do it -- law enforcement of a powerful tool used to fight for -- did. In other health care programs for example like Medicare. But Obama says not really federal health care program that lord doesn't apply. So we can do all the kickbacks we want bribes all we want we can do pretty much anything we want. -- concludes the main purpose. I'm the anti kickback law. As described by federal courts in scores of Medicare cases. It's to protect patients and taxpayers against the undue influence of money on medical decisions. So -- right claiming that obamacare is not a federal health care program is another who're you going to believe me for instance. He says those of us who detected Marxist influences in Barack Obama's past. Apparently failed to realize that the marks in question. Was -- I gotta get what he's gone for their gradual march but I mean this is -- or did you know I didn't know. But there it is in the New York Times. They've ruled that neither the exchange nor the subsidies. Our federal health care programs and therefore are exempt. From lol. Did -- -- kickbacks bribes. And rebates. So what does the gist of that it means they know it's full of fraud. They know it's going to be full of fraud the hole is a fraud. And the laws don't apply to them why. -- 1126. Quick break local news coming up next. This is the Russ castle show. Howard and charge my batteries specialists aren't getting hot at these Senate Finance Committee senator John Cornyn ticking on Kathleen civilian and repeated time and time again. And the only thing I can conclude is that. It's impossible. To do something in this administration that gets you fired. It's impossible. He can lie to the American people you can consistently misrepresent the facts but it's impossible. To get fired so don't ask you about the navigators. The presence in Dallas Texas today touting the navigator program. Which as you know is -- people who were hired to help people navigate. The Affordable Care Act. But I would just like to ask you this question if you would answer it. Isn't it true that there is no federal requirement for navigators to undergo a criminal background check. Even though they will receive personal. Sensitive personal information from the individuals they help sign up for the affordable care. That is true states could add an additional. Background checks and other features but it is not part of the federal requirements so convicted felon. Could be a navigator and could acquire sensitive personal information from an individual unbeknownst to them. That is possible. We have contracts with the organizations. And they have taken the responsibility. To. A screen there individual. Navigators and make sure that they are a sufficiently trained for the job. And there's a self access station but it is possible. Thank you senator very much December. But thank you mr. chairman that. The secretary nice to see you I want to start with a letter from Steve and a small business owner and Hudson won the most conservative suburbs Akron suburbs. In our state he said. I'm a father and small business owner I begin my business in 2009 decide to quit might state job it's the best decision I ever made a more successful to date and I ever would have imagined. But no company would -- -- health insurance it wasn't that I couldn't afford it. But I did I didn't wanna pay the cost they couldn't get insurance at any price due to preexisting conditions now thanks Affordable Care Act my family is now ensure oval. I get letters like this all the time I think we all do what I did there from all kinds of people from all kinds of walks of life that that this matters to them wanted to ask you this site -- and just spoke of the difficulty of implementing a huge social insurance program if you will. The difficulty of opening Social Security -- -- Medicare. You can go back to your -- junior senior high school I think in senator Portman hometown. When your father -- a member of congress that -- year voted for Medicare. I and I I am I suppose he shared stories with you about the opposition in those days. On the leading Republican politicians like congressman dole and congressman Rumsfeld and congressman's fight Gerald Ford voted against it. -- is that John Birch Society. Insurance companies the AMA opposed Medicare. In fact it doesn't -- rolling out of it was so controversial especially because of Medicare. Resulted in integrating southern hospitals. In if you think this is controversial what's happening now imagine the difficulty a year after civil rights and less any -- the time the voting rights passing. That Medicare forced hospitals to integrate so -- this whole view that. This is so controversial this is so unprecedented. When your -- lot of new program but the the important thing I think is. Five years later five years later people look back on Medicare but what was the big deal. Why were people so oppose this is working for our country so tell me five years from now or 45 years from now 48 years after Medicare now. What what are people gonna say about the Affordable Care Act in five years and in 48 years. I'm hopeful that come this will be another. Significant step forward in ensuring that all Americans have. Access to affordable health coverage which is not. While we can claim today where the only western. Country which doesn't have that. Health care as a basic right. And I think this is a significant. Feature for not only uninsured. Americans and they will have access for the first time. Either to Medicaid expansion or to. Affordable plans in the marketplace. But also. Those individuals who have been referred to a number of times in the individual market. Kind of glass marketplace where they don't. Enjoy the consumer protections that every other person who has helped carry in their workplace enjoys no pre existing condition limitations. Unknown medical underwriting virtually a 100% of people in the individual market are medically underwritten if you're healthy that's great. If you're not healthy. February and in terrible trouble and these are folks who want health insurance and there because. They want health insurance so I think this is a significant. Stepped forward and and one that we will look. Back on hopefully and and the apply the day that. We finally made this significant step seventy years. God I did that happen at the at the authority folks really -- like a few minutes last year. So the question is -- you look back -- Medicare you notice and doing inject a little civil rights lingo and their make it about race. And then five years from now when -- 'cause Medicare so great you know scorn broke its unsustainable. Medicaid is expanding an alarming levels how we pay for all that they're at the end to what's coming. It's a piece -- shared with you earlier from American spectator there's there's gonna have to be a proposed bailout. Because all of the stuff sounds great but. I'd even pay for.
